The license for the Tallassee Shoals
Hydroelectric Project No. 6951 was
issued for a period ending September
30, 2023.
Section 15(a)(1) of the FPA, 16 U.S.C.
808(a)(1), requires the Commission, at
the expiration of a license term, to issue
from year-to-year an annual license to
the then licensee(s) under the terms and
conditions of the prior license until a
new license is issued, or the project is
otherwise disposed of as provided in
section 15 or any other applicable
section of the FPA. If the project’s prior
license waived the applicability of

section 15 of the FPA, then, based on
section 9(b) of the Administrative
Procedure Act, 5 U.S.C. 558(c), and as
set forth at 18 CFR 16.21(a), if the
licensee of such project has filed an
application for a subsequent license, the
licensee may continue to operate the
project in accordance with the terms
and conditions of the license after the
minor or minor part license expires,
until the Commission acts on its
application. If the licensee of such a
project has not filed an application for
a subsequent license, then it may be
required, pursuant to 18 CFR 16.21(b),
to continue project operations until the
Commission issues someone else a
license for the project or otherwise
orders disposition of the project.
If the project is subject to section 15
of the FPA, notice is hereby given that
an annual license for Project No. 6951
is issued to Tallassee Shoals, LLC for a
period effective October 1, 2023,
through September 30, 2024, or until the
issuance of a new license for the project
or other disposition under the FPA,
whichever comes first. If issuance of a
new license (or other disposition) does
not take place on or before September
30, 2024, notice is hereby given that,
pursuant to 18 CFR 16.18(c), an annual
license under section 15(a)(1) of the
FPA is renewed automatically without
further order or notice by the
Commission, unless the Commission
orders otherwise.
If the project is not subject to section
15 of the FPA, notice is hereby given
that Tallassee Shoals, LLC is authorized
to continue operation of the Tallassee
Shoals Hydroelectric Project under the
terms and conditions of the prior license
until the issuance of a subsequent
license for the project or other
disposition under the FPA, whichever
comes first.

SUPPLEMENTARY INFORMATION:
General Information
The General Provisions of the NSPS
in 40 Code of Federal Regulations (CFR)
part 60 and the General Provisions of
the NESHAP in 40 CFR part 61 provide
that a source owner or operator may
request a determination of whether
certain intended actions constitute the
commencement of construction,
reconstruction, or modification. 40 CFR
60.5 and 61.06. The General Provisions
in part 60 also apply to Federal and
EPA-approved state plans for existing
sources in 40 CFR part 62. See 40 CFR
62.02(b)(2). The EPA’s written responses
to source or facility-specific inquiries on
provisions in parts 60, 61 and 62 are
commonly referred to as applicability
determinations. Although the NESHAP
part 63 regulations [which include
Maximum Achievable Control
Technology (MACT) standards and/or
Generally Available Control Technology
(GACT) standards] contain no specific
regulatory provision providing that
sources may request applicability
determinations, the EPA also responds
to written inquiries regarding
applicability for the part 63 regulations.
In addition, the General Provisions in
parts 60 and 63 allow sources to seek
permission to use monitoring or
recordkeeping that is different from the
promulgated requirements. See 40 CFR
60.13(i), 61.14(g), 63.8(b)(1), 63.8(f), and
63.10(f). The EPA’s written responses to
these inquiries are commonly referred to
as alternative monitoring decisions.
Furthermore, the EPA responds to
written inquiries about the broad range
of regulatory requirements in 40 CFR
parts 60 through 63 as they pertain to

a whole source category. These inquiries
may pertain, for example, to the type of
sources to which the regulation applies,
or to the testing, monitoring,
recordkeeping, or reporting
requirements contained in the
regulation. The EPA’s written responses
to these inquiries are commonly referred
to as regulatory interpretations.
The EPA previously compiled EPAissued NSPS and NESHAP applicability
determinations, alternative monitoring
decisions, and regulatory
interpretations, and posted them to the
ADI. As of October 2, 2023, the EPA
determinations of compliance and
applicability under Clean Air Act 111,
112, and 129 will be posted to the Clean
Air Act 111, 112, and 129 Dashboard.
The Clean Air Act 111, 112, and 129
Dashboard is a data system, accessed via
the internet, containing all
determinations signed after May 2019.
This notice comprises a list of 173

SUPPLEMENTARY INFORMATION:
General Information
The General Provisions of the NSPS in 40 Code of Federal
Regulations (CFR) part 60 and the General Provisions of the NESHAP in
40 CFR part 61 provide that a source owner or operator may request a
determination of whether certain intended actions constitute the
commencement of construction, reconstruction, or modification. 40 CFR
60.5 and 61.06. The General Provisions in part 60 also apply to Federal
and EPA-approved state plans for existing sources in 40 CFR part 62.
See 40 CFR 62.02(b)(2). The EPA's written responses to source or
facility-specific inquiries on provisions in parts 60, 61 and 62 are
commonly referred to as applicability determinations. Although the
NESHAP part 63 regulations [which include Maximum Achievable Control
Technology (MACT) standards and/or Generally Available Control
Technology (GACT) standards] contain no specific regulatory provision
providing that sources may request applicability determinations, the
EPA also responds to written inquiries regarding applicability for the
part 63 regulations. In addition, the General Provisions in parts 60
and 63 allow sources to seek permission to use monitoring or
recordkeeping that is different from the promulgated requirements. See
40 CFR 60.13(i), 61.14(g), 63.8(b)(1), 63.8(f), and 63.10(f). The EPA's
written responses to these inquiries are commonly referred to as
alternative monitoring decisions. Furthermore, the EPA responds to
written inquiries about the broad range of regulatory requirements in
40 CFR parts 60 through 63 as they pertain to a whole source category.
These inquiries may pertain, for example, to the type of sources to
which the regulation applies, or to the testing, monitoring,
recordkeeping, or reporting requirements contained in the regulation.
The EPA's written responses to these inquiries are commonly referred to
as regulatory interpretations.
The EPA previously compiled EPA-issued NSPS and NESHAP
applicability determinations, alternative monitoring decisions, and
