Endangered Species Act
Section 7(a)(2) of the Endangered
Species Act of 1973 (ESA; 16 U.S.C.
1531 et seq.) requires that each Federal
agency insure that any action it
authorizes, funds, or carries out is not
likely to jeopardize the continued
existence of any endangered or
threatened species or result in the
destruction or adverse modification of
designated critical habitat. To ensure
ESA compliance for the issuance of
IHAs, NMFS consults internally
whenever we propose to authorize take
for endangered or threatened species, in
this case with the ESA Interagency
Cooperation Division within NMFS’
OPR.
The NMFS OPR ESA Interagency
Cooperation Division issued a Biological
Opinion under section 7 of the ESA, on
the issuance of an IHA to L–DEO under
section 101(a)(5)(D) of the MMPA by the
NMFS OPR Permits and Conservation
Division. The Biological Opinion
concluded that the action is not likely
to jeopardize the continued existence of
ESA-listed blue whales, fin whales, sei
whales, and sperm whales.

National Environmental Policy Act
(NEPA)
In compliance with the National
Environmental Policy Act of 1969 (42
U.S.C. 4321 et seq.), as implemented by
the regulations published by the
Council on Environmental Quality (40
CFR parts 1500–1508), the NSF
prepared an Environmental Analysis
(EA) to consider the direct, indirect, and
cumulative effects to the human
environment from the planned marine
geophysical survey off of Puerto Rico.
NSF’s EA was made available to the
public for review and comment in
relation to its suitability for adoption by
NMFS in order to assess the impacts to
the human environment of issuance of
an IHA to L–DEO. In compliance with
NEPA and the Council on
Environmental Quality regulations, as
well as NOAA Administrative Order
216–6, NMFS has reviewed the NSF’s
EA, determined it to be sufficient, and
adopted that EA and signed a Finding
of No Significant Impact (FONSI)
available on our website at https://
www.fisheries.noaa.gov/action/
incidental-take-authorization-lamontdoherty-earth-observatorys-marinegeophysical-surveys. NSF’s EA is

SUPPLEMENTARY INFORMATION:
I. Background
The Inspector General Act of 1978, as
amended, created the Offices of
Inspectors General as independent and
objective units to conduct and supervise
audits and investigations relating to
Federal programs and operations. The
Inspector General Reform Act of 2008
established the Council of the Inspectors
General on Integrity and Efficiency
(CIGIE) to address integrity, economy,
and effectiveness issues that transcend
individual Government agencies; and
increase the professionalism and
effectiveness of personnel by developing
policies, standards, and approaches to
aid in the establishment of a welltrained and highly skilled workforce in
the Offices of Inspectors General. CIGIE
is an interagency council whose
executive chair is the Deputy Director
for Management, Office of Management
and Budget, and is comprised
principally of the 75 Inspectors General
(IGs).
II. CIGIE Performance Review Board
Under 5 U.S.C. 4314(c)(1)–(5), and in
accordance with regulations prescribed
by the Office of Personnel Management,
each agency is required to establish one
or more Senior Executive Service (SES)
performance review boards. The
purpose of these boards is to review and
evaluate the initial appraisal of a senior
executive’s performance by the
supervisor, along with any
recommendations to the appointing
authority relative to the performance of
the senior executive. The current
