Falls, Iowa, and milepost 41.5 in
Charles City, Iowa (the Line).
CCP and CEDR have entered into a
March 23, 2023 written trackage rights
agreement 2 that grants CCP overhead
trackage rights over the Line. According
to the verified notice, the transaction,
together with another transaction that
would grant CCP and CEDR limited
trackage rights over a connecting rail

The transaction may be consummated
on or after October 1, 2023, the effective

initio. Petitions to revoke the exemption
under 49 U.S.C. 10502(d) may be filed
at any time. The filing of a petition to
revoke will not automatically stay the
effectiveness of the exemption. Petitions
for stay must be filed no later than
September 22, 2023 (at least seven days
before the exemption becomes
effective).
