authority of section 337 of the Tariff Act
of 1930, as amended (19 U.S.C. 1337),
and of §§ 201.10 and 210.8(c) of the
Commission’s Rules of Practice and
Procedure (19 CFR 201.10, 210.8(c)).

SUPPLEMENTARY INFORMATION: These
third-party notifications and
recordkeeping requirements help ensure
polygraph examinees receive the
protections and rights provided by the
Employee Polygraph Protection Act
(EPPA). For additional substantive
information about this ICR, see the
related notice published in the Federal
Register on February 28, 2023 (88 FR
12701).
This information collection is subject
to the PRA. A Federal agency generally
cannot conduct or sponsor a collection
of information, and the public is
generally not required to respond to an
information collection, unless the OMB
approves it and displays a currently
valid OMB Control Number. In addition,
notwithstanding any other provisions of
law, no person shall generally be subject
to penalty for failing to comply with a
collection of information that does not
display a valid OMB Control Number.
