Next Steps
This notice is provided pursuant to
section 10(c) of the ESA. NMFS will
evaluate the application, associated

during the comment period to
determine whether the application
meets the requirements of section 10(a)
of the ESA. If NMFS determines that the
requirements are met, a permit will be
issued for incidental takes of ESA-listed
sturgeon. NMFS will publish a record of
its final action in the Federal Register.

Instructor Prohibited Activities
Acknowledgement,’’ certifies the
understanding and acknowledgement of
activities that the instructor will not
participate in with a cadet, trainee, or
student. This collection will be used by
each education facility where a JROTC
program is conducted.
The DD Form X859, ‘‘JROTC Student/
Parent/Guardian Acknowledgement of
Expected Standards of Conduct and
Participation,’’ documents student and
parent or guardian’s understanding of
the expectations, responsibilities, and
prohibitions related to participation in
the JROTC program, and is used by the
Military Service and hosting School
District to establish standard operating
procedures and code of conduct
amongst the instructor and trainee. It
also informs the student and parent or
guardian of the resources available
should an incident take place that
requires assistance and or reporting.

Memorandum of Agreement (MOA)’’
establishes the contractual
acknowledgement and understanding of
the responsibilities that the school/
instructor/student must maintain in the
