The pumped storage hydropower project will consist of: (1) a new upper reservoir with a surface area of 4,800 acres and a storage volume of 400,000 acre-feet at a maximum water-surface elevation of 8,810 feet mean sea level; (2) a new lower reservoir with a surface area of 5,400 acres and a storage volume of 400,000 acre-feet at a maximum water-surface elevation of 5,910 MSL; (3) a 60-foot-wide, 1,200-foot-long and 100-foot-high subterranean powerhouse with twelve pump/turbines rated at 250 megawatts; (4) a 40-foot wide and 33,000-foot-long conduit to the powerhouse; (5) 12-foot-wide, 1,000foot-long powerhouse lower conduit; and (6) approximately 50 miles of 550kilovolt transmission line for connection to existing lines. The estimated annual energy production of the project would be approximately 6,570,000 megawatt-hours. On June 20, 2023, the Marlow Hydro, LLC, filed a request to withdraw its surrender application. No motion in opposition to the request for withdrawal has been filed, and the Commission has taken no action to disallow the withdrawal. Pursuant to Rule 216(b) of the Commission’s Rules of Practice and Procedure,1 the withdrawal of the application became effective on July 5, 2023, and this proceeding is hereby terminated. The Commission issued Notice of Authorization for Continued Project Operation on December 22, 2022. Accordingly, Marlow Hydro, LLC, has been authorized to continue operation of the Nash Mill Dam Hydroelectric Project under the terms and conditions of the prior license until the issuance of a new license for the project or the project is otherwise disposed of under the FPA. under 40 CFR 1501.10(b)(1) require that EAs be completed within 1 
year of the Federal action agency's decision to prepare an EA. The 
Commission's October 28, 2022, notice established the Commission's 
intent to prepare an EA for the Jefferson Mill Project. Therefore, 
in accordance with CEQ's regulations, the EA must be issued by 
October 28, 2023.
