Download as PDF 45330 Federal Register / Vol. 88, No. 135 / Monday, July 17, 2023 / Rules and Regulations exclusion under the National Environmental Policy Act (42 U.S.C. 4321 et seq.) and its implementing regulations at 40 CFR part 1500, and in accordance with FAA Order 1050.1F, Environmental Impacts: Policies and Procedures, paragraph 5–6.5a, which categorically excludes from further environmental impact review rulemaking actions that designate or modify classes of airspace areas, airways, routes, and reporting points (see 14 CFR part 71, Designation of Class A, B, C, D, and E Airspace Areas; Air Traffic Service Routes; and Reporting Points), and paragraph 5–6.5i, which categorically excludes from further environmental review the establishment of new or revised air traffic control procedures conducted at 3,000 feet or more above ground level (AGL); procedures conducted below 3,000 feet AGL that do not cause traffic to be routinely routed over noise sensitive areas; modifications to currently approved procedures conducted below 3,000 feet AGL that do not significantly increase noise over noise sensitive areas; and increases in minimum altitudes and landing minima. As such, this action is not expected to result in any potentially significant environmental impacts. In accordance with FAA Order 1050.1F, paragraph 5–2 regarding Extraordinary Circumstances, the FAA has reviewed this action for factors and circumstances in which a normally categorically excluded action may have a significant environmental impact requiring further analysis. Accordingly, the FAA has determined that no extraordinary circumstances exist that warrant preparation of an environmental assessment or environmental impact study. AGENCY: This amendment adopts miscellaneous amendments to the required IFR (instrument flight rules) altitudes and changeover points for certain Federal airways, jet routes, or direct routes for which a minimum or maximum en route authorized IFR altitude is prescribed. This regulatory action is needed because of changes occurring in the National Airspace System. SUPPLEMENTARY INFORMATION: This amendment to part 95 of the Federal Aviation Regulations (14 CFR part 95) amends, suspends, or revokes IFR altitudes governing the operation of all aircraft in flight over a specified route or any portion of that route, as well as the changeover points (COPs) for Federal airways, jet routes, or direct routes as prescribed in part 95. The Rule The specified IFR altitudes, when used in conjunction with the prescribed changeover points for those routes, ensure navigation aid coverage that is adequate for safe flight operations and free of frequency interference. The PO 00000 Frm 00002 Fmt 4700 Sfmt 4700 reasons and circumstances that create the need for this amendment involve matters of flight safety and operational efficiency in the National Airspace System, are related to published aeronautical charts that are essential to the user and provide for the safe and efficient use of the navigable airspace. In addition, those various reasons or circumstances require making this amendment effective before the next scheduled charting and publication date of the flight information to assure its timely availability to the user. The effective date of this amendment reflects those considerations. In view of the close and immediate relationship between these regulatory changes and safety in air commerce, I find that notice and public procedure before adopting this amendment are impracticable and contrary to the public interest and that good cause exists for making the amendment effective in less than 30 days. Conclusion The FAA has determined that this regulation only involves an established body of technical regulations for which frequent and routine amendments are necessary to keep them operationally current. For the same reasons discussed in the preceding paragraph, waiting for a 30-day notice period to run would be impracticable and contrary to the public interest. A. Regulatory Planning and Review III. Legal Authority and Need for Rule The Regulatory Flexibility Act of 1980, 5 U.S.C. 601–612, as amended, requires Federal agencies to consider the potential impact of regulations on small entities during rulemaking. The term ‘‘small entities’’ comprises small businesses, not-for-profit organizations that are independently owned and operated and are not dominant in their fields, and governmental jurisdictions with populations of less than 50,000. The Coast Guard certifies under 5 U.S.C. 605(b) that this rule will not have a significant economic impact on a substantial number of small entities. The duration of the zone is intended to protect personnel, vessels, and the marine environment from potential hazards created by fallout of the fireworks display. No vessel or person will be permitted to enter the safety zone without obtaining permission from the COTP or a designated representative. V. Regulatory Analyses We developed this rule after considering numerous statutes and Executive orders related to rulemaking. Below we summarize our analyses based on a number of these statutes and Executive orders, and we discuss First Amendment rights of protestors. Accordingly, this rule has not been reviewed by the Office of Management and Budget (OMB). This regulatory action determination is based on characteristics of the safety zone. SUMMARY: This amendment adopts miscellaneous amendments to the required 
IFR (instrument flight rules) altitudes and changeover points for 
certain Federal airways, jet routes, or direct routes for which a 
minimum or maximum en route authorized IFR altitude is prescribed. This 
regulatory action is needed because of changes occurring in the 
National Airspace System. These changes are designed to provide for the 
safe and efficient use of the navigable airspace under instrument 
conditions in the affected areas.

SUPPLEMENTARY INFORMATION: This amendment to part 95 of the Federal 
Aviation Regulations (14 CFR part 95) amends, suspends, or revokes IFR 
altitudes governing the operation of all aircraft in flight over a 
specified route or any portion of that route, as well as the changeover 
points (COPs) for Federal airways, jet routes, or direct routes as 
prescribed in part 95.

The Rule

    The specified IFR altitudes, when used in conjunction with the 
prescribed changeover points for those routes, ensure navigation aid 
coverage that is adequate for safe flight operations and free of 
frequency interference. The reasons and circumstances that create the 
need for this amendment involve matters of flight safety and 
operational efficiency in the National Airspace System, are related to 
published aeronautical charts that are essential to the user and 
provide for the safe and efficient use of the navigable airspace. In 
addition, those various reasons or circumstances require making this 
amendment effective before the next scheduled charting and publication 
date of the flight information to assure its timely availability to the 
user. The effective date of this amendment reflects those 
considerations. In view of the close and immediate relationship between 
these regulatory changes and safety in air commerce, I find that notice 
and public procedure before adopting this amendment are impracticable 
and contrary to the public interest and that good cause exists for 
making the amendment effective in less than 30 days.

Conclusion

    The FAA has determined that this regulation only involves an 
established body of technical regulations for which frequent and 
routine amendments are necessary to keep them operationally current. 
It, therefore--(1) is not a ``significant regulatory action'' under 
Executive Order 12866; (2) is not a ``significant rule'' under DOT

Regulatory Policies and Procedures (44 FR 11034; February 26, 1979); 
and (3) does not warrant preparation of a regulatory evaluation as the 
anticipated impact is so minimal. For the same reason, the FAA 
certifies that this amendment will not have a significant economic 
impact on a substantial number of small entities under the criteria of 
the Regulatory Flexibility Act.
