IV. Conclusion
On the basis of the foregoing, the
Commission finds that the proposed
rule change is consistent with the
requirements of the Act, and in
particular, with the requirements of
Section 17A(b)(3)(F) of the Act, and
Rules 17Ad–22(e)(2)(i), (e)(2)(v), and
(e)(3)(ii) thereunder.17
It is therefore ordered pursuant to
Section 19(b)(2) of the Act 18 that the
proposed rule change (SR–ICC–2023–
008), be, and hereby is, approved.19
To obtain
the information needed to carry out its
oversight responsibilities under the
Small Business Investment Act, the
Small Business Administration (SBA)
requires Small Business Investment
Companies (SBICs) to submit financial
statements and supplementary
information on SBA Form 468. SBA
uses this information to monitor SBIC
financial condition and regulatory
compliance, for credit analysis when
considering SBIC leverage applications,
and to evaluate financial risk and
economic impact for individual SBICs
and the program as a whole.
