Under the Act, a species may be removed from the Federal Lists of Endangered and Threatened Wildlife and Plants (i.e., ‘‘delisted’’) if it is determined that the species has recovered and no longer meets the definition of an endangered species or a threatened species. Delisting a species can only be completed by issuing a rule through the Administrative Procedure Act rulemaking process (5 U.S.C. 551 et seq.). What this document does. This rule removes the Okaloosa darter (Etheostoma okaloosae) from the List of Endangered and Threatened Wildlife based on its recovery. The basis for our action.
