certification request must comply with
40 CFR 121.5(b), including
documentation that a pre-filing meeting
request was submitted to the certifying
authority at least 30 days prior to
submitting the certification request.
Please also note that the certification
request must be sent to the certifying
authority and to the Commission
concurrently.

Western Power Pool; Notice of Petition
for Waiver
Take notice that on June 9, 2023,
Northwest Power Pool d/b/a Western
Power Pool (WPP or Petitioner), filed a
petition for waiver of the Federal Energy
Regulatory Commission’s (Commission)
requirement to provide its FERC Form
No. 3–Qs for 2023 on the basis that WPP
was not a public utility until January 1,
2023 and requires additional time to
align its accounting with the
Commission’s Uniform System of
Accounts, all as more fully explained in
the petition.
Any person desiring to intervene or to
protest this filing must file in
accordance with Rules 211 and 214 of
the Commission’s Rules of Practice and
Procedure (18 CFR 385.211, 385.214).
Protests will be considered by the
Commission in determining the
appropriate action to be taken but will
not serve to make protestants parties to
the proceeding. Any person wishing to
become a party must file a notice of
intervention or motion to intervene, as
appropriate. Such notices, motions, or
protests must be filed on or before the
comment date. Anyone filing a motion
to intervene, or protest must serve a

Power Authority of the State of New
York; Notice of Waiver Period for
Water Quality Certification Application
On June 1, 2023, the Power Authority
of the State of New York submitted to
the Federal Energy Regulatory
Commission (Commission) a copy of its
application for a Clean Water Act
section 401(a)(1) water quality
certification filed with the New York
State Department of Environmental
Conservation (New York DEC), in
conjunction with the above captioned
project. Pursuant to 40 CFR 121.6 and
section 5.23(b) of the Commission’s
regulations,1 we hereby notify the New
York DEC of the following:
Date of Receipt of the Certification
Request: May 26, 2023.
Reasonable Period of Time to Act on
the Certification Request: One year (May
26, 2024).
