records. Providing an individual with
notification of, access to, or the right to
seek amendment of HPP records could
disclose the identity of confidential
sources, reveal investigative techniques,
and interfere with enforcement
proceedings.
(iii) 5 U.S.C. 552a(e)(4)(I) requires the
publication of the categories of sources
of records in each system of records.
Revealing the sources of information in
HPP records could discourage such
sources from cooperating with
investigations of alleged harassment for
fear of reprisal. In addition, the
disclosure of VA’s investigative
techniques and procedures and
compromise the ability to conduct
impartial investigations into workplace
and sexual harassment allegations.
(iv) 5 U.S.C. 552a(e)(1) requires each
agency to maintain in its records only
such information about an individual
that is relevant and necessary to
accomplish a purpose of the agency
required by statute or Executive order.
The relevance or necessity of specific
information in HPP records often cannot
be detected in the early stages of an
investigation and can only be
established after the information is
evaluated. Further, a thorough and
complete investigation could involve
information that at first appears
incidental but ultimately becomes
critical to the investigation.

SUPPLEMENTARY INFORMATION: In the
Final Rules section of this issue of the

State’s SIP submittal as a direct final
rule without prior proposal because the
Agency views this as a noncontroversial
submittal and anticipates no adverse
comments. A detailed rationale for the
approval is set forth in the direct final
rule. If no relevant adverse comments
are received in response to this rule, no
further activity is contemplated. If EPA
receives such comments, the direct final
rule will be withdrawn and all public

a subsequent final rule based on this
proposed rule. EPA will not institute a

I. Summary
On April 13, 2023, the EPA published
in the Federal Register an ANPRM
seeking public input and data to assist
in the consideration of potential
development of future regulations
pertaining to per- and polyfluoroalkyl
substances (PFAS) under the
Comprehensive Environmental
Response, Compensation, and Liability
Act (CERCLA or Superfund). The
agency is seeking input and data
regarding potential future CERCLA
hazardous substance designation for
seven PFAS, besides perfluorooctanoic
acid (PFOA) and
perfluorooctanesulfonic acid (PFOS),
and their salts and structural isomers, or
some subset thereof; precursors (a
precursor is a chemical that is
transformed into another compound
through the course of a degradation
process) to PFOA, PFOS, and seven
other PFAS; and/or categories of PFAS.
The ANPRM’s comment period was
scheduled to end on June 12, 2023.
Since publication, EPA has received
several requests to extend that comment
period to allow for additional time to
develop comments on the ANPRM.
