SUPPLEMENTARY INFORMATION: Background.—On March 6, 2023, the Commission determined that the domestic interested party group response to its notice of institution (87 FR 73784, December 1, 2022) of the subject five-year reviews was adequate and that the respondent interested party group response was inadequate. The Commission did not find any other circumstances that would warrant conducting full reviews.1 Accordingly, the Commission determined that it would conduct expedited reviews pursuant to section 751(c)(3) of the Tariff Act of 1930 (19 U.S.C. 1675(c)(3)). The case involves claims under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended (‘‘CERCLA’’), for, among others, injunctive relief and recovery of the United States’ past and future response costs. The settlement resolves the United States’ claims by requiring the County to: (1) undertake a non-time-critical removal action to address site contamination; (2) reimburse the United States’ past response costs; and (3) reimburse the United States’ future response costs. The publication of this notice opens a period for public comment on the Consent Decree.
