activity to the FTZ Board for its facility

The notification was processed in
accordance with the regulations of the
FTZ Board (15 CFR part 400), including
notice in the Federal Register inviting
public comment (87 FR 72446,
November 25, 2022). On March 17,
2023, the applicant was notified of the
FTZ Board’s decision that no further
review of the activity is warranted at
this time. The production activity
described in the notification was
authorized, subject to the FTZ Act and
the FTZ Board’s regulations, including
Section 400.14.

SUMMARY: The U.S. Department of
Commerce (Commerce) preliminarily
determines that imports of certain
aluminum foil (aluminum foil) that
were exported from the Republic of
Korea (Korea) and from the Kingdom of
Thailand (Thailand), using inputs (i.e.,
aluminum foil- and sheet-gauge
products) manufactured in the People’s
Republic of China (China), as specified
below, are circumventing the
antidumping duty (AD) and
countervailing duty (CVD) orders on
aluminum foil from China.

SUPPLEMENTARY INFORMATION:
Background
On April 19, 2018, Commerce
published in the Federal Register AD
and CVD Orders on U.S. imports of
aluminum foil from China.1 On July 11,
2022, pursuant to section 781(b) of the
Tariff Act of 1930, as amended (the Act),
and 19 CFR 351.226(b), Commerce selfinitiated country-wide circumvention
inquiries to determine whether imports
of aluminum foil, completed in Korea
and Thailand (collectively, the third
countries), using inputs (i.e., aluminum
foil- and sheet-gauge products)
manufactured in China, are
circumventing the Orders and,
accordingly, should be covered by the
scope of the Orders.2 On October 11,
2022, Commerce selected two
respondents from each of the examined
third countries as the mandatory
respondents in these circumvention
inquiries.3
On December 1, 2022, Commerce
extended the deadline for issuing the
preliminary determinations in these
circumvention inquiries by 75 days,
until February 28, 2023, and extended
the deadline for issuing the final
determinations by 65 days, until July 18,
2023.4 On February 27, 2023, Commerce
further extended the deadlines for
issuing the preliminary and final
determinations in these circumvention
inquiries by an additional 15 days each,
until March 15, 2023, and August 2,
2023, respectively.5 For a complete
