Approval of Expansion of Subzone
18G, Tesla, Inc., Oakland, California
On December 7, 2022, the Executive
Secretary of the Foreign-Trade Zones
(FTZ) Board docketed an application
submitted by the City of San Jose,
grantee of FTZ 18, requesting an
expansion of Subzone 18G subject to the
existing activation limit of FTZ 18, on
behalf of Tesla, Inc., in Oakland,
California.
The application was processed in
accordance with the FTZ Act and
Regulations, including notice in the
Federal Register inviting public
comment (87 FR 76178, December 13,
2022). The FTZ staff examiner reviewed
the application and determined that it
meets the criteria for approval. Pursuant
to the authority delegated to the FTZ
Board Executive Secretary (15 CFR
400.36(f)), the application to expand
Subzone 18G was approved on February
2, 2023, subject to the FTZ Act and the
Board’s regulations, including Section
400.13, and further subject to FTZ 18’s
2,000-acre activation limit.

On August 5, 2022, Commerce
published the Preliminary Results of the
2020–2021 administrative review of the
antidumping duty order on certain steel
nails from Malaysia.1 We invited
interested parties to comment on the
Preliminary Results.2 On November 21,
2022, we extended the deadline for
these final results until February 1,
2023.3 This review covers two
mandatory respondents: Region and
Inmax.4 The producers/exporters not
selected for individual examination are
referenced in the ‘‘Final Results of
Review’’ section below and listed in
Appendix II of this notice. For a
complete description of the events that
followed the Preliminary Results, see
the Issues and Decision Memorandum.5
Commerce conducted this
administrative review in accordance
with section 751 of the Tariff Act of
1930, as amended (the Act).
Scope of the Order
The products covered by the scope of
the order are certain steel nails from
Malaysia. For a complete description of
the scope of the order, see the Issues
and Decision Memorandum.6

Analysis of Comments Received
All issues raised in the case and
rebuttal briefs filed by interested parties
in this review are discussed in the
Issues and Decision Memorandum. A
list of the topics included in the Issues
and Decision Memorandum is attached
as Appendix I to this notice. The Issues
and Decision Memorandum is a public
document and is made available to the
public via Enforcement and
Compliance’s Antidumping and
Countervailing Duty Centralized
Electronic Service System (ACCESS).

Final Determination of No Shipments
In the Preliminary Results, Commerce
determined that Astrotech Steels Private
Limited, Trinity Steel Private Limited,
and Geekay Wires Limited made no
shipments of the subject merchandise to
the United States during the POR. No
parties commented on this
determination. Therefore, for the final
results of review, we continue to find
that these companies made no
shipments of subject merchandise to the
United States during the POR.
Consistent with our practice, we will
issue appropriate instructions to U.S.
Customs and Border Protection (CBP)
based on our final results.
Changes Since the Preliminary Results
Based on the comments received from
interested parties regarding our
Preliminary Results, we made certain
changes to the margin calculation
methodology used in the Preliminary
Results and have changed the dumping
margin for these final results of review,
as discussed in the Issues and Decision
Memorandum.
Rates for Non-Selected Respondents
The statute and Commerce’s
regulations do not address the
establishment of a rate to be applied to
companies not selected for individual
examination when Commerce limits its
examination in an administrative review
pursuant to section 777A(c)(2) of the
Act. Generally, Commerce looks to
section 735(c)(5) of the Act, which
provides instructions for calculating the
all-others rate in a market economy
investigation, for guidance when
calculating the rate for companies
which were not selected for individual
examination in an administrative
review. Under section 735(c)(5)(A) of
the Act, the all-others rate is normally
‘‘an amount equal to the weighted
