SUPPLEMENTARY INFORMATION: The NRC
has received an application from NSPM,
dated January 9, 2023, filed pursuant to
section 103 of the Atomic Energy Act of
1954, as amended, and part 54 of title
10 of the Code of Federal Regulations,
‘‘Requirements for Renewal of Operating
Licenses for Nuclear Power Plants,’’ to
renew the operating license for MNGP.
The current operating license was
previously renewed on November 8,
2006. Subsequent renewal of the license
would authorize the applicant to
operate the facility for an additional 20year period beyond the period specified
in the current operating license. The
current operating license for MNGP
expires September 8, 2030. The MNGP
is a Boiling Water Reactor located in
Monticello, Minnesota. The
acceptability of the tendered application
for docketing, and other matters,
including an opportunity to request a
hearing, will be the subject of
subsequent Federal Register notices.

I. Introduction
On May 13, 2022, Cboe BZX
Exchange, Inc. (‘‘BZX’’ or ‘‘Exchange’’)
filed with the Securities and Exchange
Commission (‘‘Commission’’), pursuant
to Section 19(b)(1) of the Securities
Exchange Act of 1934 (‘‘Exchange
Act’’) 1 and Rule 19b–4 thereunder, 2 a
proposed rule change to list and trade
shares (‘‘Shares’’) of the ARK 21Shares
Bitcoin ETF (‘‘Trust’’) under BZX Rule

Shares. The proposed rule change was
published for comment in the Federal
Register on June 1, 2022.3
On July 12, 2022, pursuant to Section
19(b)(2) of the Exchange Act,4 the
Commission designated a longer period
within which to approve the proposed
rule change, disapprove the proposed
rule change, or institute proceedings to
determine whether to disapprove the
proposed rule change.5 On August 29,
2022, the Commission instituted
proceedings under Section 19(b)(2)(B) of
the Exchange Act 6 to determine
whether to approve or disapprove the
proposed rule change, 7 and on
November 15, 2022, the Commission
designated a longer period for
Commission action on the proposed rule
change.8
This order disapproves the proposed
rule change. The Commission concludes
that BZX has not met its burden under
the Exchange Act and the Commission’s
Rules of Practice to demonstrate that its
proposal is consistent with the
requirements of Exchange Act Section
6(b)(5), which requires, in relevant part,
that the rules of a national securities
exchange be ‘‘designed to prevent
fraudulent and manipulative acts and
practices’’ and ‘‘to protect investors and
the public interest.’’ 9
When considering whether BZX’s
proposal to list and trade the Shares is
designed to prevent fraudulent and
manipulative acts and practices, the
Commission applies the same analytical
framework used in its orders
considering previous proposals to list
bitcoin 10-based commodity trusts and
