Introduction A. Statutory Background In recognition of the significant impact that the activities of the Enterprises have on the U.S. housing finance system, market participants, and the broader economy, section 1321 of the Federal Housing Enterprises Financial Safety and Soundness Act of 1992, as amended (12 U.S.C. 4501 et seq.) (the Safety and Soundness Act or Act) requires the FHFA Director to review new Enterprise activities and to approve new Enterprise products before these activities and products can be offered to the market. Specifically, the Act requires an Enterprise to provide ‘‘written notice’’ to the Director for a determination of whether a new activity is a new product subject to prior approval under section 1321.
