Abstract: Section 3005 of subtitle C of
RCRA requires treatment, storage or
disposal facilities (TSDFs) to obtain a
permit. To obtain the permit, the TSDFs

must submit an application describing
the facility’s operation. There are two
parts to the RCRA permit application—
Part A and Part B. Part A defines the
processes to be used for treatment,
storage, and disposal of hazardous
wastes; the design capacity of such
processes; and the specific hazardous
wastes to be handled at the facility. Part
B requires detailed site-specific
information such as geologic,
hydrologic, and engineering data. In the
event that permit modifications are
proposed by the applicant or the EPA,
modifications must conform to the
requirements under sections 3004 and
3005.

Small Municipal Waste Combustors (40
CFR part 60, subpart AAAA) apply to
both existing facilities and new facilities
with small municipal waste combustors
(MWCs) that combust greater than 35
tons per day (tpd), but with less than
250 tpd of municipal solid waste. In
general, all NSPS standards require
initial notifications, performance tests,
and periodic reports by the owners/
operators of the affected facilities. They
are also required to maintain records of
the occurrence and duration of any
startup, shutdown, or malfunction in
the operation of an affected facility, or
any period during which the monitoring
system is inoperative. These
notifications, reports, and records are
essential in determining compliance,
and are required of all affected facilities
subject to NSPS.
