k. Description of Request: Indiana
Michigan Power Company (licensee) is
requesting Commission approval of a
non-project use of project lands and
water application for the purposes of
permitting the St. Joseph County
Surveyor (proponent) to undergo
maintenance dredging of an existing
channel (Woodward Ditch) within the
Project boundary to remove
approximately 3,883 cubic yards of
accumulated sediment by hydraulic
dredge. The original channel bottom
will not be disturbed. The licensee is
planning to dispose of the spoil in an
upland manmade body of surface water
created by excavating (agricultural
irrigation pond) which was determined
by U.S. Army Corps of Engineers to not
be a jurisdictional water. The proposed
dredging area is inside the project
boundary, but the disposal area is
outside of the project boundary.

n. Comments, Protests, or Motions to
Intervene: Anyone may submit

Commission will consider all protests or
other comments filed, but only those
who file a motion to intervene in
