Pursuant to the Congressional Review Act (5 U.S.C. 801 et seq.), the Office of Management and Budget Office of Information and Regulatory Affairs has designated this as a major rule, as defined by 5 U.S.C. 804(2). The Congressional Review Act (CRA) requires a 60-day delay in the effective date of a major rule from the date of publication in the Federal Register or receipt of the rule by Congress, whichever is later (5 U.S.C. 801(a)(3)(A)). The rule was published on October 3, 2022, and Congress received the interim final rule on October 6, 2022. Therefore, the effective date is extended by four days to December 6, 2022, which is at least 60 days from Congress’ receipt of the interim final rule.
