(collectively, the ‘‘Participants’’) filed with the Securities and Exchange Commission (‘‘Commission’’) pursuant to Section 11A(a)(3) of the Exchange Act,2 and Rule 608 thereunder,3 a proposed amendment (‘‘Proposed Amendment’’) to the CAT NMS Plan that would authorize CAT LLC to revise the Consolidated Audit Trail Reporter Agreement and the Consolidated Audit Trail Reporter Agent Agreement by: (1) removing the arbitration provision from each agreement and replacing it with a forum selection provision, which would require that any dispute regarding CAT reporting be filed in a United States District Court for the Southern District of New York, or, in the absence of federal subject matter jurisdiction, a New York State Supreme Court within the First Judicial Department; (2) adding a jury waiver provision; (3) adding a disclaimer of warranties clause; and (4) revising the existing choice of law clause to provide that any dispute will be governed by federal law (in addition to New York law).4 The Proposed Amendment was published for lotter on DSK11XQN23PROD with NOTICES1 1 The CAT NMS Plan is a national market system plan approved by the Commission pursuant to Section 11A of the Securities Exchange Act of 1934 (‘‘Exchange Act’’) and the rules and regulations thereunder. Notice. AGENCY: ACTION: Under title II of the Social Security Act (Act), there will be an 8.7 percent cost-of-living increase in Social Security benefits effective December 2022. In addition, the national average wage index for 2021 is $60,575.07. The cost-of-living increase and national average wage index affect other program parameters as described below. (2) The special benefit amount under title VIII of the Act for certain World War II (WWII) veterans will be $685.50 for 2023. (3) The student earned income exclusion under title XVI of the Act will be $2,220 per month in 2023, but not more than $8,950 for all of 2023. (4) The dollar fee limit for services performed as a representative payee will be $52 per month ($97 per month in the case of a beneficiary who is determined to be disabled and has an alcoholism or drug addiction condition that leaves them incapable of managing benefits) in 2023. (5) The assessment (or ‘‘user fee’’) dollar limit on the administrative cost charged when the agency pays authorized representative fees directly out of a claimant’s past due benefits will be $113, beginning in December 2022.
