The Congressional Review Act, 5
U.S.C. 801 et seq., as added by the Small
Business Regulatory Enforcement
Fairness Act of 1996, generally provides
that before a rule may take effect, the
agency promulgating the rule must
submit a rule report, which includes a
copy of the rule, to each House of the
Congress and to the Comptroller General
of the United States. EPA will submit a
report containing this document and
other required information to the U.S.
Senate, the U.S. House of
Representatives, and the Comptroller
General of the United States prior to
publication in the Federal Register. A
major rule cannot take effect until 60
days after it is published in the Federal
Register. This action is not a ‘‘major
rule’’ as defined by 5 U.S.C. 804(2).
However, this action will not be
effective until December 19, 2022
because it is a direct final rule.

SUPPLEMENTARY INFORMATION:
Background
VA published a proposed rule in the
Federal Register at 87 FR 13598 on
March 9, 2022, to amend the VAAR to
implement and supplement the Federal
Acquisition Regulation (FAR). VA
provided a 60-day comment period for
the public to respond to the proposed
rule and submit comments. The public
comment period closed on May 9, 2022.
VA received no public comments.
This rulemaking is issued under the
authority of the Office of Federal
Procurement Policy (OFPP) Act which
provides the authority for an agency
head to issue agency acquisition
regulations that implement or
supplement the FAR.
The VAAR has been revised to add
new policy or regulatory requirements,
to update existing policy, and to remove
any redundant guidance where it may
exist in affected parts, and to place
guidance that is applicable only to VA’s
internal operating processes or
procedures in the VA Acquisition
Manual (VAAM).
This rule adopts as a final rule the
proposed rule published in the Federal
Register on March 9, 2022, except for
one technical non-substantive revision
as described below.

This rule makes one non-substantive
change to the rule to provide clarity,
eliminate confusion, and to ensure
compliance with the Federal
Acquisition Regulation (FAR).
Specifically, in section 819.7002,
Applicability, VA is revising the term
‘‘commercial acquisitions’’ as used in
the section to reflect ‘‘commercial
products or commercial services’’ in
alignment with FAR final rule, Federal
Acquisition Regulation: Revision of
Definition of ‘‘Commercial Item’’, RIN
9000–AN76, effective December 6, 2021.
