In addition, section 1102(b) of the Act
requires us to prepare an RIA if a rule

1102(b) of the Act, we define a small
rural hospital as a hospital that is
located outside of a metropolitan
statistical area and has fewer than 100
beds. This annual notice announces the

will have an impact on the Medicare
beneficiaries. As a result, we are not
preparing an analysis for section 1102(b)
of the Act because the Secretary has

E. Unfunded Mandates Reform Act
Section 202 of the Unfunded
Mandates Reform Act of 1995 also
requires that agencies assess anticipated
costs and benefits before issuing any
rule whose mandates require spending
in any 1 year of $100 million in 1995
dollars, updated annually for inflation.
In 2022, that threshold is approximately
$165 million. This notice would not
impose a mandate that will result in the
expenditure by state, local, and Tribal
Governments, in the aggregate, or by the
private sector, of more than $165
million in any 1 year.
F. Federalism
Executive Order 13132 establishes
certain requirements that an agency
must meet when it promulgates a
proposed rule (and subsequent final
rule) that imposes substantial direct
requirement costs on state and local
governments, preempts state law, or
otherwise has Federalism implications.
This notice will not have a substantial
direct effect on state or local
governments, preempt state law, or
otherwise have Federalism implications.

50354 of the BBA provides for a number
of purposes and limitation for the use of
the claims data and also permits the
Secretary to establish other limitations
necessary to protect the identity of
individuals entitled to or enrolled in
Medicare, and to protect the security of
personal health information.
This information collection request
allows a PDP sponsor to submit a
request to CMS for claims data for its
enrollees and to attest that it will adhere
to the permitted uses and limitations on

Request: Extension of a currently

Certifications/Recertifications in Skilled
Nursing Facilities Manual Instruction;
Use: Section 1814(a) of the Social
Security Act (the Act) requires specific
certifications in order for Medicare
payments to be made for certain
services. Before the enactment of the
Omnibus Budget Reconciliation Act of
1989 (OBRA1989, Pub. L. 101–239),
section 1814(a)(2) of the Act required
that, in the case of posthospital
extended care services, a physician
certify that the services are or were
required to be given because the
individual needs or needed, on a daily
basis, skilled nursing care (provided
directly by or requiring the supervision
of skilled nursing personnel) or other
skilled rehabilitation services that, as a
practical matter, can only be provided
in a SNF on an inpatient basis.
