NMFS finds the application warrants
further consideration based on a
preliminary review. Possible conditions
the agency may impose on the EFP, if
granted, include but are not limited to,
a prohibition on fishing within marine
protected areas, marine sanctuaries, or
special management zones without
additional authorization. A final
decision on issuance of the EFP will
depend on NMFS’ review of public
comments received on the application,
consultations with the appropriate
fishery management agencies of the
affected states, the South Atlantic
Fishery Management Council, and the
U.S. Coast Guard, and a determination
that the activities to be taken under the
EFP are consistent with all other
applicable laws.

for formal consideration and action, if
appropriate.

SUPPLEMENTARY INFORMATION:
Agenda
The Herring Committee will meet to
review recommendations from the
Herring Plan Development Team and
Herring Advisory Panel. They will
review draft Atlantic herring
specifications and river herring and
shad catch caps for fishing years 2023–
25 and recommend preferred
alternatives. The Committee will
consider recommending to the Council
a change in priorities to discontinue
work on Framework Adjustment 7 to
protect adult spawning herring on
Georges Bank. They will also discuss
possible herring priorities for 2023 and
make recommendations to the Council,
as appropriate. Other business may be
discussed, as necessary.
Although non-emergency issues not
contained on the agenda may come
before this Council for discussion, those
issues may not be the subject of formal
action during this meeting. Council
action will be restricted to those issues
specifically listed in this notice and any
issues arising after publication of this
notice that require emergency action
under section 305(c) of the MagnusonStevens Act, provided the public has
been notified of the Council’s intent to
take final action to address the
emergency. The public also should be
aware that the meeting will be recorded.
Consistent with 16 U.S.C. 1852, a copy
of the recording is available upon
request.
