The complaint seeks injunctive relief and civil penalties based on violations of the Clean Air Act’s New Source Review requirements, New Source Performance Standards, National Emissions Standards for Hazardous Air Pollutants, ‘‘Title V’’ program requirements and operating permits, and related Texas state implementation plan requirements. The alleged violations involve flares used at three petrochemical manufacturing facilities owned and operated by the defendant, in or near Cedar Bayou, Port Arthur and Sweeny, Texas. Under the proposed consent decree, the defendant has agreed to perform injunctive relief (including flare gas minimization, flaring efficiency measures, and fenceline monitoring) that is estimated to cost $118 million, and pay $3.4 million in civil penalties.     On March 9, 2022, the Department of Justice lodged a proposed 
consent decree with the United States District Court for the Southern
