In the notice of proposed IHA (86 FR 70451; December 10, 2021), NMFS described its plan to adopt the Navy’s EA, provided our independent evaluation of the document found that it includes adequate information analyzing the effects on the human environment of issuing the IHA. In compliance with NEPA and the CEQ regulations, as well as NOAA Administrative Order 216–6, NMFS has reviewed the Navy’s EA and determined it to be sufficient. NMFS adopted that EA and signed a Finding of No Significant Impact (FONSI) on February 4, 2022. Endangered Species Act Section 7(a)(2) of the Endangered Species Act of 1973 (ESA: 16 U.S.C. 1531 et seq.) requires that each Federal agency insure that any action it authorizes, funds, or carries out is not likely to jeopardize the continued existence of any endangered or threatened species or result in the destruction or adverse modification of designated critical habitat. To ensure ESA compliance for the issuance of IHAs, NMFS consults internally whenever we propose to authorize take for endangered or threatened species, in this case with NMFS’ Alaska Regional Office (AKRO). The NMFS Office of Protected Resources (OPR) is authorizing take of ringed seals, which are listed under the ESA. The NMFS Alaska Regional Office Protected Resources Division issued a Biological Opinion on January 31, 2022, which concluded that the Navy’s activities and NMFS’ issuance of an IHA are not likely to jeopardize the continued existence of the Arctic stock of ringed seals. There is no ESA designated critical habitat for ringed seals. Authorization NMFS has issued an IHA to the Navy for conducting submarine training and testing activities in the ICEX22 Study Area of the Arctic Ocean beginning in February 2022 that includes the previously explained mitigation, monitoring, and reporting requirements.
