AGENCY: We, the U.S. Fish and Wildlife Service (Service), propose to list the Sacramento Mountains checkerspot butterfly (Euphydryas anicia cloudcrofti), a butterfly from New Mexico, as an endangered species under the Endangered Species Act of 1973, as amended (Act). After a review of the best available scientific and commercial information, we find that listing the species is warranted. Accordingly, we propose to list the Sacramento Mountains checkerspot butterfly as an endangered species under the Act. If we finalize this rule as proposed, it would add this species to the List of Endangered and Threatened Wildlife and extend the Act’s protections to the species. We find that the designation of critical habitat for the Sacramento Mountains checkerspot butterfly is not determinable at this time. SUMMARY: The Resource Conservation and Recovery Act of 1976 (RCRA), as 
amended, authorizes the Environmental Protection Agency (EPA) to grant 
approval to states to operate their underground storage tank (UST) 
programs in lieu of the Federal program. The Commonwealth of Kentucky 
(Commonwealth or State) applied to the EPA for final approval to its 
UST Program on October 7, 2019, and on September 16, 2020, the EPA 
published a final determination and approval of the Commonwealth's UST 
Program. This action proposes to codify the EPA's prior approval of the 
Commonwealth's UST Program and to incorporate by reference approved
