Description of Request: Sabine River Authority—LA & TX proposes a new article (i.e., Article 417—Project Administration) to be included in the project license. The project boundary is based mostly on metes and bounds surveys over 1,130 miles around the reservoir that were meant to provide a 50-foot buffer from the water’s edge. At the time of initial surveying (i.e., the 1960s), surveyors were allowed variances of up to 75 feet to the landward side of the project boundary, which resulted in the licensee acquiring, in many instances, more property than is needed for project purposes. The article would allow the licensee to adjust the project boundary under certain circumstances without prior Commission approval to ensure that the project boundary includes only those lands needed for project purposes. Specifically, the licensee would be able to make adjustments for lands that meet all three of these conditions: (1) Located entirely above the elevation 175 feet mean sea level contour; (2) located at least 50 feet from the reservoir shoreline; and (3) not otherwise needed for project purposes (i.e., project works, recreation, aquatic and terrestrial resource protection, shoreline control, or cultural resource protection). The licensee would file biennial reports describing its activities under the article, including revised Exhibit G (project boundary) drawings, if necessary. l.
