Complainant may file replies to any written submissions no later than three calendar days after the date on which any initial submissions were due. The complaint seeks civil penalties and injunctive relief arising from alleged violations of requirements to (1) submit monthly status reports, a final control plan, and a site-specific monitoring plan; (2) perform required testing; (3) meet emission limits for sulfur dioxide and hydrochloric acid; and (4) establish and meet operating limits. The consent decree requires the settling defendants to pay a civil penalty of $373,660, plus interest, and to take measures to bring the facility into compliance.
