Federal Register / Vol. 86, No. 239 / Thursday, December 16, 2021 / Rules and Regulations
for public comment to implement the
quota transfer is impracticable and
contrary to the public interest as such a
delay would likely result in an earlier
closure of the fishery while fish are
available on the fishing grounds. For all
of the above reasons, there is good cause
under 5 U.S.C. 553(d) to waive the 30day delay in effectiveness.

NMFS
manages the NWHI commercial lobster
fishery under the Fishery Ecosystem
Plan for the Hawaiian Archipelago. The
regulations at 50 CFR 665.252(b) require
NMFS to publish an annual harvest
guideline for lobster Permit Area 1,
comprised of Federal waters around the
NWHI.
Regulations governing the

lobsters (50 CFR 404.10(a)).
Accordingly, NMFS establishes the
harvest guideline for the NWHI
