The United States and the Louisville Metro Air Pollution Control District (‘‘District’’) filed a complaint against Louisville Gas & Electric Company (‘‘LG&E’’) alleging violations of the Clean Air Act (‘‘Act’’) at LG&E’s Mill Creek facility in Jefferson County, Kentucky. The claims alleged in the complaint and resolved by the proposed consent decree concern LG&E’s emission of sulfuric acid mist. The proposed consent decree requires LG&E to pay a $750,000 civil penalty, perform a supplemental environmental project estimated to cost $540,000, and perform injunctive relief. The publication of this notice opens a period for public comment on the proposed consent decree.
