The Consent Decree provides for payment of a civil penalty of $3,100,000 ($1,675,000 to the United States and $1,425,000 to the State of Texas), payment of attorneys’ fees to the State of Texas, and performance of injunctive relief to resolve the violations alleged in the Complaint. The United States’ complaint names as defendants Buckeye Pipe Line Company, L.P., the operator of the pipeline, and West Shore Pipe Line Company, the owner of the pipeline. Both defendants signed the proposed Consent Decree to resolve these claims, agreeing to pay a total of $1,500,000 in civil penalties and $7,200,000 in natural resource damages and wetland mitigation. Notice of Lodging of Proposed Consent Decree Under the Clean 
Water Act and Oil Pollution Act

    On October 13, 2021, the Department of Justice lodged a proposed 
Consent Decree with the United States District Court for the Northern 
District of Illinois in the lawsuit entitled United States and Illinois 
v. Buckeye Pipe Line Company, L.P. and West Shore Pipe Line Company, 
Civil Action No. 21-cv-5424.
    The United States filed a Complaint for civil penalties and
