In accordance with 40 CFR 2.306(j),
EPA has determined that under EPA
contract number 68HERD20A0002/
68HERH21F0196, ERG will require
access to CBI submitted to EPA under
all sections of TSCA to perform
successfully the duties specified under
the contract. ERG personnel will be
given access to information submitted to
EPA under all sections of TSCA. Some
of the information may be claimed or
determined to be CBI.
EPA is issuing this notice to inform
all submitters of information under all
sections of TSCA that EPA may provide
ERG access to these CBI materials on a
need-to-know basis only. All access to
TSCA CBI under this contract will take
place at EPA Headquarters and ERG’s
site located at 14555 Avion Parkway,
Suite 200, Chantilly, VA, in accordance
with EPA’s TSCA CBI Protection
Manual.
Access to TSCA data, including CBI,
will continue until April 21, 2022. If the
contract is extended, this access will
also continue for the duration of the
extended contract without further
notice.
ERG personnel will be required to
sign nondisclosure agreements and will
be briefed on appropriate security
procedures before they are permitted
access to TSCA CBI.

Under the
Agreement, the Settling Parties will pay
$75,000 to the EPA Hazardous
Substance Superfund in reimbursement
of EPA’s Past Response Costs paid at or
in connection with the Site. The
Agreement includes a covenant by EPA
not to sue or to take administrative
action against the Settling Parties
pursuant to Section 107(a) of CERCLA,
42 U.S.C. 9607(a), to recover such Past
Response Costs. For thirty (30) days
following the date of publication of this
notice, EPA will receive written
comments relating to the Agreement.
EPA will consider all comments
received and may modify or withdraw
its consent to the Agreement if
comments received disclose facts or
considerations that indicate that the
proposed Agreement is inappropriate,
improper, or inadequate. EPA’s
response to any comments received will
be available for public inspection at
EPA Region 2, 290 Broadway, New
York, New York 10007–1866.

Rodenticide Act (FIFRA), EPA is hereby
providing notice of receipt and
opportunity to comment on these
applications.
