(Complainants) filed a formal complaint against El Paso Natural Gas Company, LLC (Respondent), alleging that the Respondent’s failure to waive and imposition of Critical Operating Condition charges and penalties for the period February 15, 2021 through February 17, 2021 is unjust and unreasonable, unreasonably punitive, and inconsistent with Commission policy and precedent, all as more fully explained in its complaint. The Settlement Agreement includes protection, mitigation, and enhancement measures addressing project operation, minimum flows, dissolved oxygen, Delaware River dwarf wedgemussel, downstream fish passage, upstream passage of American eel, and management plans for shorelines, recreation, whitewater flows, bald eagles, northern long-eared bat, invasive plants, and historic properties. Eagle Creek requests that the measures in the Settlement Agreement be incorporated as license conditions, without modification, in any license issued for each project.
