December 31, 2020. Triton Power
provided public notice of its request on
December 29, 2020. In a letter dated
February 26, 2021, the Director of the
Division of Hydropower Licensing
approved Triton Power’s request to use
the Traditional Licensing Process.
k. With this notice, we are initiating
informal consultation with the U.S. Fish
and Wildlife Service and/or NOAA
Fisheries under section 7 of the
Endangered Species Act and the joint
agency regulations thereunder at 50
CFR, part 402; and NOAA Fisheries
under section 305(b) of the MagnusonStevens Fishery Conservation and
Management Act and implementing
regulations at 50 CFR 600.920. We are
also initiating consultation with the
New York State Historic Preservation
Officer, as required by section 106,
National Historic Preservation Act, and
the implementing regulations of the
Advisory Council on Historic
Preservation at 36 CFR 800.2.
l. With this notice, we are designating
Triton Power as the Commission’s nonfederal representative for carrying out
informal consultation pursuant to
section 7 of the Endangered Species Act
and consultation pursuant to section
106 of the National Historic
Preservation Act.
m. Triton Power filed a PreApplication Document (PAD; including
a proposed process plan and schedule)
with the Commission, pursuant to 18
CFR 5.6 of the Commission’s
regulations.

analysis.
The Council on Environmental
Quality (CEQ) issued a final rule on July
15, 2020, revising the regulations under
40 CFR parts 1500–1518 that federal
agencies use to implement NEPA (see
Update to the Regulations Implementing
the Procedural Provisions of the
National Environmental Policy Act, 85
FR 43,304). The Final Rule became
effective on and applies to any NEPA
process begun after September 14, 2020.
An agency may also apply the
regulations to ongoing activities and
environmental documents begun before
September 14, 2020, which includes the
proposed Mother Ann Lee Project.
Commission staff intends to conduct its
NEPA review in accordance with CEQ’s
new regulations.
l. The Mother Ann Lee Project
consists of the following existing
facilities: (1) A reservoir with a surface
area of 777 acres and a storage capacity
of 5,828 acre-feet at elevation 513.12
