received a special permit request from
Tejas, a subsidiary of Kinder Morgan,
Inc., seeking a waiver from the
requirements of 49 CFR 192.611(a) and
(d): Change in class location:
Confirmation or revision of maximum
allowable operating pressure, and 49
CFR 192.619(a): Maximum allowable
operating pressure: Steel or plastic
pipelines. This special permit is being
requested in lieu of pipe replacement or
pressure reduction for one (1) pipeline
segment totaling 1,929 feet
(approximately 0.37 miles) of 30-inch
diameter pipe on the King Ranch to
Lovell Pipeline located in Chambers
County, Texas. The proposed special
permit will allow operation of the
original Class 1 pipe in the Class 3
location.
The proposed special permit segment
on the Tejas King Ranch to Lovell
Pipeline has a maximum allowable
operating pressure of 703 pounds per
square inch gauge and was constructed
in 1958.
The special permit request, proposed
special permit with conditions, and
Draft Environmental Assessment (DEA)
for the Tejas King Ranch to Lovell
Pipeline are available for review and
public comments in Docket No.
PHMSA–2019–0153. PHMSA invites
interested persons to review and submit
comments on the special permit request

AGENCY:
This notice details the
adjustment made to the rail passenger
transportation liability cap as required
by section 11415 of the Fixing
America’s Surface Transportation
(FAST) Act (December 4, 2015).
Pursuant to the FAST Act, the rail
passenger transportation liability cap is
raised from $294,278,983 to
$322,864,228.
SUMMARY:
This adjustment will go into
effect 30 days after February 25, 2021.

SUPPLEMENTARY INFORMATION: The
Department of Transportation is
publishing the inflation adjusted index
factors for the rail passenger
transportation liability cap under 49
U.S.C. 28103(a)(2), as directed by
section 11415 of the FAST Act. The
index methodology ensures that the
aggregate allowable awards to all rail
passengers, against all defendants, for
all claims, including claims for punitive
damages, arising from a single accident
or incident is based on current dollars
and is adjusted for inflation from the
$200,000,000 cap that went into effect
on December 2, 1997.
Under the FAST Act, the index is
adjusted to the date of enactment of the
FAST Act using the Bureau of Labor
Statistics Consumer Price Index—All
Urban Consumers.
