Nature and Extent of Confidentiality:
If the Commission requests respondents
to submit information to the
Commission or to USAC that the
respondents believe is confidential, the
respondents may request confidential
treatment of such information pursuant
to 47 CFR 0.459 of the Commission’s
rules.
Needs and Uses: The Commission
will submit this information collection
to the Office of Management and Budget
(OMB) after this 60-day comment period
in order to obtain the full three year
clearance from OMB. Under 47 U.S.C.
276(b)(1)(C), the Bell Operating
Companies (BOCs) are required to
publicly disclose changes in their
networks or new network services.
Sections 276(b)(1)(C) directs the
Commission to ‘‘prescribe a set of
nonstructural safeguards for BOC
payphone service to implement the
provisions of paragraphs (1) and (2) of
subsection (a), which safeguards shall,
at a minimum, include the
nonstructural safeguards equal to those
adopted in the Computer Inquiry–III (CC
Docket No. 90–623) proceeding.’’ The
Computer Inquiry-III network
information disclosure requirements
specifically state that the disclosure
would occur at two different points in
time. First, disclosure would occur at
the make/buy point: When a BOC
decides to make for itself, or procure
from an unaffiliated entity, any product
whose design affects or relies on the
network interface. Second, a BOC would
publicly disclose technical information
about a new service 12 months before it
is introduced. If the BOC can introduce
the service within 12 months of the
make/buy point, it would make a public
disclosure at the make/buy point. In no
event, however, would the public
disclosure occur less than six months
before the introduction of the service.
While the scope and applicability of the
Computer III safeguards have changed
with the Commission’s 2015 decision
regarding forbearance from enforcement
of the Computer III requirements
(Petition of USTelecom for Forbearance
Pursuant to 47 U.S.C. Section 160(c)
from Enforcement of Obsolete ILEC
Regulations that Inhibit Deployment of
Next Generation Networks,
Memorandum Opinion and Order, FCC
15–166 (2015)), these are minimum
requirements under section 276(b)(1)(C)
of the Act. Without information
disclosures, the industry would be
unable to ascertain whether the BOCs
are designing new network services or
changing network technical
specifications to the advantage of their
own payphones, or in a manner that

Nature and Extent of Confidentiality:
Information provided pursuant to this
request will be viewed as presumptively
confidential upon submission because
the information would reflect reports on
weaknesses in or damage to national
communications infrastructure, and the
release of this sensitive information to
the public could potentially facilitate
terrorist targeting of critical
infrastructure and key resources. The
submissions also may contain internal
confidential information that constitutes
trade secrets and commercial/financial
information that the respondent does
not routinely make public and public
release of the submitted information
could cause competitive harm by
revealing information about the types
and deployment of cable equipment and
the traffic that flows across the system.
For these reasons, the information
requested in (b) (Terrestrial Route Map)
and (c) (Undersea Location Spreadsheet)
above is presumptively exempt from
public disclosure under Freedom of
Information Act (FOIA) Exemption 3, 5
U.S.C. 552(b)(3), and section 4(j) of the
Communications Act of 1934, as

considered exempt under Exemption 4
of the Freedom of Information Act
(FOIA), 5 U.S.C. 552(b)(4). If a FOIA
request is filed for information
submitted in response to this request,
the respondent whose records are the
subject of the request will be notified of
the FOIA request and given the
opportunity to oppose release of the
records. See 47 CFR 0.461(d)(3). We
note that the information provided in
response to this request will be shared
with the Department of Homeland
Security’s National Communications
System (NCS) and relevant Executive
Branch agencies on a confidential basis.

Needs and Uses: This information is
needed in order to support Federal
government national security and
emergency preparedness
communications programs, for the
purposes of providing situational
awareness of submarine cable system
performance as well as a greater
understanding of potential physical
threats to the submarine cable systems.
This information will provide
situational awareness regarding the
operational status of submarine cable
systems to the Federal government, and
allow the Executive Branch to assess
potential risks and threats to these
critical communications systems in the
context of other available information.
