report containing this action and other
required information to the U.S. Senate,
the U.S. House of Representatives, and
the Comptroller General of the United
States prior to publication of the rule in
the Federal Register. A major rule
cannot take effect until 60 days after it
is published in the Federal Register.
This action is not a ‘‘major rule’’ as
defined by 5 U.S.C. 804(2).
Under section 307(b)(1) of the Clean
Air Act, petitions for judicial review of
this action must be filed in the United
States Court of Appeals for the
appropriate circuit by December 7,
2020. Filing a petition for
reconsideration by the Administrator of
this final rule does not affect the finality
of this action for the purposes of judicial
review nor does it extend the time
within which a petition for judicial
review may be filed, and shall not
postpone the effectiveness of such rule
or action. This action may not be
challenged later in proceedings to
enforce its requirements. (See section
307(b)(2).)

Identification of plan.
(a) The plan for the control of
emissions from existing municipal solid
waste landfills, submitted by the Oregon
Department of Environmental Quality
on May 14, 1997, to implement the
emission guideline of 40 CFR part 60,
subpart Cc, applies to all existing MSW
landfill facilities in Oregon meeting the
requirements as stated in their State
regulations.
(b) The plan for the control of
emissions from existing municipal solid
waste landfills, submitted by the Oregon
Department of Environmental Quality
on August 2, 2019, to implement the
emission guideline of 40 CFR part 60,
subpart Cf, applies to all existing MSW

Oregon must comply with the
requirements in paragraph (b) of this
section.

FIFRA section 25(a)(2)(B) requires the
EPA Administrator to provide the
Secretary of USDA with a copy of any
draft final rule at least 30 days before
signing it in final form for publication
in the Federal Register. The draft final
rule is not available to the public until
after it has been signed by EPA. If the
Secretary of USDA comments in writing
regarding the draft final rule within 15
days after receiving it, the EPA
Administrator must include the
comments of the Secretary of USDA, if
requested by the Secretary of USDA,
and the EPA Administrator’s response
to those comments with the final rule
that publishes in the Federal Register.
If the Secretary of USDA does not
comment in writing within 15 days after
receiving the draft final rule, the EPA
Administrator may sign the final rule for
publication in the Federal Register any
time after the 15-day period.
II. Do any Statutory and Executive
Order reviews apply to this
notification?
No. This document is merely a
notification of submission to the

Kasugamycin; Pesticide Tolerances for
Emergency Exemptions
Environmental Protection
Agency (EPA).
ACTION: Final rule.
This regulation establishes
time-limited tolerances for residues of
kasugamycin in or on almonds. This
action is in response to EPA’s granting
of an emergency exemption under the
Federal Insecticide, Fungicide, and
Rodenticide Act (FIFRA) authorizing
use of the pesticide on almond trees.
This regulation establishes maximum
permissible levels for residues of
kasugamycin in or on this commodity.
The time-limited tolerances expire on
December 31, 2023.
DATES: This regulation is effective
October 8, 2020. Objections and
requests for hearings must be received
on or before December 7, 2020, and
must be filed in accordance with the
instructions provided in 40 CFR part
178 (see also Unit I.C. of the
SUPPLEMENTARY INFORMATION).
