ACTION: Notice; request for public comment. AGENCY: In accordance with the Comprehensive Environmental Response, Compensation, and Liability Act, as amended (‘‘CERCLA’’), notice is hereby given of a proposed administrative settlement for recovery of past and projected future response costs concerning the Former Kaiser Smelter Site, Mead, Washington, with the following settling party: Spokane Recycling Company. The settlement requires the settling party to pay 50% of the net sales proceeds of the sale of the Property or $325,000, whichever is less to EPA to be used to conduct or finance response actions undertaken at the Site or to be transferred by EPA to the Hazardous Substance Superfund. The settlement includes a covenant not to sue the settling party. For thirty (30) days following the date of publication of this document, the Agency will receive written comments relating to the settlement. The Agency will consider all comments and may modify or withdraw its consent to the settlement if comments received disclose facts or considerations which indicate that the settlement is inappropriate, improper, or inadequate.
