According to California statute, ‘‘[n]o
person other than a physician . . . shall
write or issue a prescription.’’ Cal.
Health & Safety Code § 11150 (West
2020). Further, ‘‘physician,’’ as defined
by California statute, is a person who is
‘‘licensed to practice’’ in California. Id.
at § 11024.
Here, the undisputed evidence in the
record is that Registrant currently lacks
authority to practice medicine in
California. As already discussed, a
physician must be a licensed
practitioner to dispense a controlled
substance in California. Thus, because
Registrant lacks authority to practice
medicine in California and, therefore, is
not authorized to handle controlled
substances in California, Registrant is
not eligible to maintain a DEA
registration. Accordingly, I will order
that Registrant’s DEA registration be
revoked.
Order
Pursuant to 28 CFR 0.100(b) and the
authority vested in me by 21 U.S.C.
824(a), I hereby revoke DEA Certificate
of Registration No. AS6936201 issued to
Frederick M. Silvers, M.D. Further,
pursuant to 28 CFR 0.100(b) and the
authority vested in me by 21 U.S.C.
823(f), I hereby deny any pending
application of Frederick M. Silvers,
M.D. to renew or modify this
registration, as well as any pending
application of Frederick M. Silvers,
M.D. for registration in California. This
Order is effective August 27, 2020.

On July 21, 2020, the Department of
Justice lodged a proposed consent
decree with the United States District
Court for the District of Hawaii in the
lawsuit entitled United States v. Pacific
Energy South West Pacific, Ltd., Civil
Action No. 20–CV–322.
The United States filed this lawsuit
under the Clean Water Act. The United
States’ complaint seeks injunctive relief
and civil penalties for violations of a
National Pollutant Discharge
Elimination System permit, violations of
an administrative order issued by the
United States Environmental Protection
Agency, and unpermitted discharges of
pollutants to waters of the United States
at the American Samoa Terminal, a fuel
terminal that the defendant Pacific
Energy South West Pacific, Ltd.,
operates in Pago Pago, American Samoa.
The consent decree requires the
defendant to perform injunctive relief
and pay a $300,000 civil penalty.
The publication of this notice opens
a period for public comment on the
consent decree. Comments should be
addressed to the Assistant Attorney
General, Environment and Natural
Resources Division, and should refer to
United States v. Pacific Energy South
West Pacific, Ltd., D.J. Ref. No. 90–5–1–
1–12086. All comments must be
submitted no later than thirty (30) days
after the publication date of this notice.
