CDS Air Freight Inc., an operator
within FTZ 137 in Dulles, Virginia,
submitted a notification of proposed
production activity to the FTZ Board on
behalf of FN America, LLC (FNA). The
notification conforming to the
requirements of the regulations of the
FTZ Board (15 CFR 400.22) was
received on May 22, 2020.
The FNA facility is located within
FTZ 137. The facility is currently used
for the storage of firearms, but the
company is requesting authority to
remove parts from firearms stored at the
facility. Pursuant to 15 CFR 400.14(b),
FTZ activity would be limited to the
specific foreign-status materials and
components and specific finished
products described in the submitted
notification (as described below) and
subsequently authorized by the FTZ
Board.

would be able to avoid duty on foreignstatus components which become scrap/
waste. Customs duties also could
possibly be deferred or reduced on
foreign-status production equipment.
The components and materials
sourced from abroad are machine guns
(duty-free). The request indicates that
the machine guns are subject to duties
under Section 301 of the Trade Act of
1974 (Section 301), depending on the
country of origin. The applicable
Section 301 decisions require subject
merchandise to be admitted to FTZs in
privileged foreign status (19 CFR
146.41).
Public comment is invited from
interested parties. Submissions shall be
addressed to the Board’s Executive
Secretary and sent to: ftz@trade.gov. The
closing period for their receipt is July
13, 2020.

Background
On February 4, 2020, the Department
of Commerce initiated the antidumping
duty investigation on certain vertical
shaft engines between 225cc and 999cc,
and parts thereof from the People’s
Republic of China, covering the period
of investigation (POI) July 1, 2019
through December 31, 2019.1 Currently,
the preliminary determination is due no
later than June 23, 2020.
Postponement of the Preliminary
Determination
Section 733(b)(1)(A) of the Tariff Act
of 1930, as amended (the Act), requires
Commerce to issue the preliminary
determination in an antidumping
investigation within 140 days after the
date on which Commerce initiated the
investigation. However, section
733(c)(1) of the Act permits Commerce
to postpone the preliminary
determination until no later than 190
days after the date on which Commerce
initiated the investigation if: (A) The
petitioner makes a timely request for a
