The Exchange does not believe the
proposed rule change will impose any
burden on inter-market competition
because the proposed rule change
applies only to products listed on the
Exchange. Additionally, the proposed
order type is intended to accommodate
riskless transactions for parties that are
not seeking price improvement, but
rather looking to swap risk exposure,
and therefore is not intended to have a
competitive impact. Further, the
proposed rule is substantially similar to
a rule on the Cboe Exchange and may
promote inter-market competition.21

III. Date of Effectiveness of the
Proposed Rule Change and Timing for
Commission Action
Within 45 days of the date of
publication of this notice in the Federal
Register or within such longer period
up to 90 days (i) as the Commission may
designate if it finds such longer period
to be appropriate and publishes its
reasons for so finding or (ii) as to which
the self-regulatory organization
consents, the Commission will:
(A) By order approve or disapprove
such proposed rule change, or
(B) institute proceedings to determine
whether the proposed rule change
should be disapproved.

Interested persons are invited to
submit written data, views, and
arguments concerning the foregoing,
including whether the proposed rule
change is consistent with the Act.
