Abstract: In 2008, the agencies 2
issued a supervisory guidance
document for implementing the
supervisory review process (Pillar 2).3
Paragraphs 37, 41, 43, and 46 of the
guidance contain information
collections. Paragraph 37 provides that
banks should state clearly the definition
of capital used in any aspect of its
internal capital adequacy assessment
process (ICAAP) and document any
changes in the internal definition of
capital. Paragraph 41 provides that
banks should maintain thorough
documentation of ICAAP. Paragraph 43
specifies that the board of director
should approve the bank’s ICAAP,
review it on a regular basis, and approve
any changes. Boards of directors, under
Paragraph 46, should periodically, and
at least annually, review the assessment
of overall capital adequacy and analyze
how measures of internal capital
adequacy compare with other capital
measures (such as regulatory or
accounting).

responsibilities of the OCC. 12 U.S.C.
16, 481, 482 and 1467. The OCC
requires independent credit card
national banks and independent credit
card Federal savings associations
(collectively, independent credit card
institutions) to pay an additional
assessment based on receivables
attributable to accounts owned by the
national bank or Federal savings
association. 12 CFR 8.2(c). Independent
credit card institutions are national
banks or Federal savings associations
that engage primarily in credit card
operations and are not affiliated with a
full-service national bank or full-service
Federal savings association. 12 CFR
8.2(c)(3)(vi) and (vii). Under 12 CFR
8.2(c)(2), the OCC also has the authority
to assess an independent credit card
institution that is affiliated with a fullservice national bank or full-service
