Exchange notes that Trading Collar
functionality is not new or novel and is
available on other options exchanges.22
Thus, this proposal would foster
cooperation and coordination with
persons engaged in facilitating
transactions in securities, and remove
impediments to and perfect the
mechanism of a free and open market
and a national market system.
Technical Changes
The Exchange notes that the proposed
technical changes to the text regarding
the selection of the display price would
provide clarity and transparency to
Exchange rules and would remove
impediments to, and perfect the
mechanism of, a free and open market
and a national market system by making
the Exchange rules easier to navigate
and comprehend.
B. Self-Regulatory Organization’s
Statement on Burden on Competition
The Exchange does not believe that
this proposed rule change would
impose any burden on competition not
necessary or appropriate in furtherance
of the purposes of the Act. Instead, the
Exchange believes the proposal provides
modifications and enhancements to the
Trading Collars that provide market
participants with protection from
anomalous executions. Thus, the
Exchange does not believe the proposal
creates any significant impact on
competition.
The proposed enhancements to the
Trading Collars would streamline the
operation of the Trading Collars thereby
further protecting investors against the
execution of orders at erroneous prices.
As such, the proposal does not impose
any burden on competition. To the
contrary, the Exchange believes that the
proposed clarifications and
enhancements may foster more
competition. Specifically, the Exchange
notes that it operates in a highly
competitive market in which market
participants can readily favor competing
venues. The Exchange’s proposed rule
change would enhance its ability to
compete with other exchanges that

core functionality.23 Thus, the Exchange
believes that this type of competition
amongst exchanges is beneficial to the
market place as a whole as it can result
in enhanced processes, functionality,
and technologies. The Exchange further
believes that because the proposed rule
change would be applicable to all OTP
Holders it would not impose any burden
on intra-market competition that is not
necessary or appropriate in furtherance
of the purposes of the Act.

III. Date of Effectiveness of the
Proposed Rule Change and Timing for
Commission Action
Within 45 days of the date of
publication of this notice in the Federal
Register or up to 90 days (i) as the
Commission may designate if it finds
such longer period to be appropriate
and publishes its reasons for so finding
or (ii) as to which the self-regulatory
organization consents, the Commission
will:
(A) by order approve or disapprove
the proposed rule change, or
(B) institute proceedings to determine
whether the proposed rule change
should be disapproved.

arguments concerning the foregoing,
including whether the proposed rule
change, as modified by Amendment No.
2, is consistent with the Act. Comments
