and artifacts, borrowed from lenders
abroad for exhibition in the United
States, from within the United States
when the foreign works of art are
integral to the exhibition, or sent from
the United States for exhibition abroad.
The indemnity agreement is backed by
the full faith and credit of the United
States. In the event of loss or damage to
an indemnified object, the Federal
Council on the Arts and the Humanities
certifies the validity of the claim and
requests payment from Congress. 20
U.S.C. 973 et seq. requires such an
application and specifies information
which must be supplied. This statutory
requirement is implemented by
regulation at 45 CFR ll60.4.

Exemption
I. Background
Southern Nuclear Operating Company
(SNC, the licensee) is the holder of Facility
Operating License Nos. DPR–57 and NPF–5,
for the Edwin I. Hatch Nuclear Plant (HNP),
Units 1 and 2, respectively. The licenses
provide, among other things, that the licensee
is subject to all rules, regulations, and orders
of the Commission now or hereafter in effect.
The HNP facility consists of two boilingwater reactors located at the licensee’s site in
Appling County, Georgia.
II. Request/Action
Title 10 of the Code of Federal Regulations
(10 CFR), Section 50.71, ‘‘Maintenance of
records, making of reports,’’ paragraph (e)(4)
states, in part, that ‘‘Subsequent revisions [to
the Updated Final Safety Analysis Report
(UFSAR)] must be filed annually or 6 months
after each refueling outage provided that the
interval between successive updates [to the
UFSAR] does not exceed 24 months.’’ By
letter dated December 16, 2019 (Agencywide
Documents Access and Management System
(ADAMS) Accession No. ML19350C266),
SNC requested that the due date for submittal
of HNP, Unit 1, and HNP, Unit 2, UFSARs
be by August 31 of every even-numbered
year, provided the interval between
successive updates does not exceed 24
months.
III. Discussion
Pursuant to 10 CFR 50.12, the NRC may,
upon application by any interested person or
upon its own initiative, grant exemptions
from the requirements of 10 CFR part 50,
including 10 CFR 50.71(e)(4) when: (1) The
exemptions are authorized by law, will not
present an undue risk to the public health or
safety, and are consistent with the common
defense and security; and (2) when special
circumstances are present. Under 10 CFR
50.12(a)(2), special circumstances include,
among other things, when application of the
specific regulation in the particular
circumstances would not serve, or is not
necessary to achieve, the underlying purpose
of the rule.
A. The Exemption is Authorized by Law
In accordance with 10 CFR 50.12, the NRC
may grant an exemption from the
requirements of 10 CFR part 50 if the
exemption is authorized by law. The
exemption requested in this instance is
authorized by law, because no other
