o. Scoping Process
The Commission intends to prepare
an environmental assessment (EA) for
the Oak Orchard Project in accordance
with the National Environmental Policy
Act. The EA will consider both sitespecific and cumulative environmental
impacts and reasonable alternatives to
the proposed action.
Commission staff does not propose to
conduct any on-site scoping meetings at
this time. Instead, we are soliciting
comments, recommendations, and
information, on the Scoping Document
1 (SD1) issued January 14, 2020.
Copies of SD1 outlining the subject
areas to be addressed in the EA were
distributed to the parties on the
Commission’s mailing list. Copies of
SD1 may be viewed on the web at
https://www.ferc.gov using the
‘‘eLibrary’’ link. Enter the docket
number excluding the last three digits in
the docket number field to access the

k. Description of Request: The
applicant requests a temporary variance
from article 402 of its license to operate
the reservoir elevation below its normal
winter minimum elevation of 1437 feet
mean sea level (msl), to allow for
structural repairs to the Middle Dam.
The licensee would maintain a
minimum elevation of 1436.0 feet msl
from March 1 through April 15
beginning in 2020 and during the same
time period through 2024. The
drawdown would allow for the repairs
to be completed in the dry and during
the reduced recreation season. The
licensee would hold back additional
water at the Upper Dam Development,
located upstream of the Middle Dam,
during the construction years to assist in
the refill of the Middle Dam Reservoir,
Richardson Lake.
