Gridflex Energy, LLC subsequently amended its application on January 3, 2020, and again on January 14, 2020. The sole purpose of a preliminary permit, if issued, is to grant the permit holder priority to file a license application during the permit term. A preliminary permit does not authorize the permit holder to perform any land-disturbing activities or otherwise enter upon lands or waters owned by others without the owners’ express permission. Initial fill water, and make-up water for evaporation loss would be purchased from parties holding water rights associated with the San Juan Generating Station or otherwise associated with the San Juan River.
