LLC; Notice of Preliminary Permit
Application Accepted for Filing and
Soliciting Comments, Motions To
Intervene, and Competing Applications
On September 12, 2019, Lock+TM
Hydro Friends Fund XXXI, LLC, filed an
application for a preliminary permit,
pursuant to section 4(f) of the Federal
Power Act (FPA), proposing to study the
feasibility of the Beltzville Dam
Hydropower Project to be located at the
U.S. Army Corps of Engineers’ (Corps)
Beltzville Dam on Pohopoco Creek in
Carbon County, Pennsylvania. The sole
purpose of a preliminary permit, if
issued, is to grant the permit holder
priority to file a license application
during the permit term. A preliminary
permit does not authorize the permit
holder to perform any land-disturbing
activities or otherwise enter upon lands
or waters owned by others without the
owners’ express permission.
The proposed project would consist of
the following: (1) A new 30-foot-wide,
30-foot-deep, 160-foot-tall modular
frame structure to be installed at the
intake for the outlet pipe adjacent to the
outlet tower, containing two turbinegenerator units with a rated capacity of
475 kilowatts each; (2) a new switchgear
and control room located in the modular
structure; and (3) a new 13-kilovolt
transmission line connecting the
modular structure with a nearby
existing electrical grid. The proposed
project would have an annual
generation of 4,150 megawatt-hours.

Take notice that on October 22, 2019,
pursuant to Rule 207 of the Federal
Energy Regulatory Commission’s
(Commission) Rules of Practice and
Procedure,1 Branch Street Solar Partners
LLC and SSA Solar of NM 4, LLC
(collectively Petitioners), filed a petition
for a declaratory order requesting
limited waiver of the filing requirements
applicable to small power production
facilities set forth in section
292.203(a)(3) of the Commission’s
regulations 2 for the time-period
beginning when two qualifying small
power production facilities (QF’s) were
placed into operation, and ending on
February 25, 2019, when Petitioners
filed their respective QF
self-certifications, as more fully
explained in the petition.
Any person desiring to intervene or to
protest this filing must file in
accordance with Rules 211 and 214 of
the Commission’s Rules of Practice and
