According to ITB, the track lease between ITB and IC does not contain an interchange commitment. ITB certifies that its projected annual revenues as a result of the proposed transaction will not exceed $5 million and that the transaction will not result in the creation of a Class II or Class I rail carrier. This transaction may be consummated on or after October 11, 2019 (30 days after the verified notice was filed). If the verified notice contains false or misleading information, the exemption is void ab initio. Petitions to revoke the exemption under 49 U.S.C. 10502(d) may be filed at any time. The filing of a petition to revoke will not automatically stay the effectiveness of the exemption. Petitions for stay must be filed no later than October 4, 2019 (at least seven days before the exemption becomes effective). All pleadings, referring to Docket No. FD 36348, must be filed with the Surface Transportation Board either via e-filing or in writing addressed to 395 E Street SW, Washington, DC 20423–0001. user of rail service on the Line (or by a state or local government
entity acting on behalf of such user) regarding cessation of service
over the Line either is pending with the Surface Transportation Board
(Board) or with any U.S. District Court or has been decided in favor of

\3\ CSXT initially submitted its verified notice on September 3,
2019. CSXT subsequently filed an updated affidavit certifying
newspaper publication on September 9, 2019, which will be considered
the filing date in the proceeding.
\4\ The filing fee for OFAs can be found at 49 CFR
1002.2(f)(25).
\5\ Because this is a discontinuance proceeding and not an

not appropriate. Because there will be an environmental review
during abandonment, this discontinuance does not require
environmental review.
