Statement on Burden on Competition
The Exchange does not believe that
the proposed rule change will impose
any burden on competition not
necessary or appropriate in furtherance
of the purposes of the Act, as amended.
The proposed rule change is consistent
with the rules of the other exchanges
and is designed to provide for how the
Exchange would determine the NOCP
for an Exchange-listed security that is an
ETP if there is no Closing Cross, which
will help it better compete as a listing
venue.
