Construction/Installation of New Railroad or Rail Transit Infrastructure For any of the activities listed below, the federal agency shall require the work be performed by or under the supervision of an SOI-qualified professional, based on the scope of work and location of a specific proposal. This does not include substantial new construction, such as construction of new passenger stations, railyards or rail transit yards, or tunnels, or demolition of existing structures. 2. species, marine mammals, or both. We issue these permits under the 
Endangered Species Act and the Marine Mammal Protection Act.
